Tippet — Terms of Service & End User License Agreement

These Terms of Service and End User License Agreement (the "Terms") are a legal
agreement between you and Hans Zanger ("Tippet," "we," "us," or
"our") governing your use of the Tippet mobile app and related services (the
"Service"). Please read them carefully, along with our
Privacy Policy.
1. Acceptance of these Terms
By creating an account or using the Service, you agree to these Terms and to our
Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your
country) to use Tippet. By using the Service you represent that you meet this
requirement and that the information you provide is accurate.
3. Your account
You are responsible for activity under your account and for keeping your sign-in
method secure. You sign in using Sign in with Apple; you are responsible for
maintaining the security of your Apple ID. Notify us promptly of any unauthorized
use.
4. License to use the app
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable,
revocable license to download and use the Tippet app on Apple-branded devices you
own or control, for your personal, non-commercial use. You may not copy, modify,
reverse-engineer, resell, or create derivative works from the Service except as
permitted by law.
5. Your content
"Your Content" means the catches, photos, text, locations, and other material you
submit to the Service.
- You retain ownership of Your Content.
- You grant Tippet a worldwide, non-exclusive, royalty-free license to host,
store, reproduce, display, and distribute Your Content **solely to operate and
provide the Service** — for example, to show your public catches on the map, in
the feed, in leaderboards, and on your profile, in accordance with the privacy
settings you choose. This license ends when you delete the content or your
account, except for copies retained as required by law or for legitimate
backup, dispute-resolution, or enforcement purposes.
- You represent that you own or have the rights to Your Content, that it is
accurate, and that it does not violate these Terms or any law or third-party
right.
- We may create aggregated or de-identified data derived from Your Content
that does not identify you. We may use and share that data as described in our
Privacy Policy, and it is not subject to the deletion described
above.
6. Acceptable use and prohibited content
Tippet has zero tolerance for objectionable content or abusive behavior. You
agree not to post, share, or do any of the following, and not to use the Service
to:
- post content that is unlawful, harassing, bullying, threatening, hateful,
defamatory, obscene, sexually explicit, or otherwise objectionable;
- harass, abuse, impersonate, stalk, or harm another person;
- post content that infringes anyone's intellectual-property, privacy, or other
rights;
- reveal another person's private information without permission;
- spam, post misleading information, or manipulate leaderboards or metrics;
- attempt to disrupt, overload, hack, or gain unauthorized access to the Service;
or
- use the Service to violate any fishing, wildlife, access, or other applicable
law or regulation.
You are solely responsible for Your Content and your conduct on the Service.
7. Reporting, moderation, blocking, and enforcement
We want Tippet to be a safe community. To that end:
- Reporting. You can report a catch or an angler from the "…" menu. Reported
content is hidden from you immediately and is sent to us for review.
- Blocking. You can block another angler so that you and they no longer see
each other's catches or profiles.
- Moderation. We review reports and may remove content, hide catches, suspend
or ban accounts, or take other action, in our discretion. We aim to act on
reports of objectionable content promptly, and generally within 24 hours of a
report.
- No obligation to monitor. We do not pre-screen all content but reserve the
right to remove any content or terminate any account that violates these Terms.
8. Location, fishing, and personal safety
Please fish responsibly and safely. Tippet displays locations and information
submitted by users and derived from photos; we do not verify their accuracy,
legality, or safety. You are solely responsible for:
- knowing and following all applicable fishing licenses, regulations, seasons,
limits, and access/property rules for any location;
- not trespassing on private or restricted land or water; and
- your own safety and decisions in the outdoors.
Locations and conditions can be inaccurate, out of date, dangerous, or off-limits.
Tippet is provided for informational and recreational purposes only and is not a
guide to safe or lawful access.
9. Intellectual property
The Service, including its software, design, branding, and the "Tippet" name and
logo, is owned by Tippet and protected by intellectual-property laws. Except for
the license in Section 4, we grant you no rights in the Service.
10. Third-party services
The Service relies on third parties, including Apple (Sign in with Apple) and our
hosting providers. Your use of those services may be subject to their terms, and
we are not responsible for third-party services.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY
KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE
UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY LOCATION OR CONTENT IS ACCURATE,
LAWFUL, OR SAFE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIPPET AND ITS OFFICERS, EMPLOYEES, AND
SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,
OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PERSONAL
INJURY OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL
LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED
US $100. Some jurisdictions do not allow certain limitations,
so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Tippet from claims, damages, and expenses
(including reasonable legal fees) arising from Your Content, your use of the
Service, or your violation of these Terms or any law or third-party right.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend
or terminate your access if you violate these Terms or to protect the Service or
other users. Sections that by their nature should survive termination (including
5, 9, 11, 12, and 13) will survive.
15. Governing law and disputes
These Terms are governed by the laws of the State of New York, without
regard to conflict-of-laws rules. You agree that any dispute arising out of or relating to these
Terms or the Service will be resolved exclusively in the state or federal courts
located in New York, and you consent to the personal jurisdiction of those courts.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will
update the "Last updated" date and, where appropriate, provide notice in the app.
Your continued use of the Service after changes take effect constitutes
acceptance.
17. Assignment
You may not assign or transfer these Terms, or your account, without our prior
written consent. We may assign or transfer these Terms, and our rights and
obligations under them (including the licenses you grant in Section 5), to an
affiliate or successor, or in connection with a merger, acquisition,
reorganization, financing, or sale of all or part of our business or assets. These
Terms bind and benefit the parties and their permitted successors and assigns.
18. Apple App Store — additional terms
This section applies because you obtained the app from the Apple App Store:
- These Terms are between you and Tippet only, not with Apple. Apple is not
responsible for the app or its content.
- The license granted in Section 4 is limited to use on Apple-branded devices you
own or control, as permitted by the App Store Terms of Service.
- Maintenance and support for the app is Tippet's responsibility, not
Apple's.
- Warranty. To the extent of any warranty, Apple may refund the app's
purchase price (if any); otherwise Apple has no warranty obligation for the app.
- Product claims. Tippet, not Apple, is responsible for addressing any claims
relating to the app (including product-liability, legal/regulatory, and
consumer-protection claims), to the extent not excluded by these Terms.
- Intellectual property. If a third party claims the app infringes its
intellectual-property rights, Tippet, not Apple, is responsible for
investigation and resolution to the extent required by these Terms.
- You represent that you are not located in a country subject to a U.S. embargo or
designated as "terrorist-supporting," and that you are not on any U.S.
restricted-parties list.
- Apple is a third-party beneficiary of these Terms and may enforce them
against you.
